Indonesia Green Hydrogen Contracting and Legislation: Key Reports Launched to Drive Industry Growth

In collaboration with leading law firms A&O Shearman (Ginting & Reksodiputro in association with A&O Shearman), Baker McKenzie (HHP Law Firm), Witara Cakra Advocates in association with White & Case LLP, and Herbert Smith Freehills (Hiswara Bunjamin & Tandjung), the Green Hydrogen Organisation (GH2) has successfully launched four critical reports outlining financing and legislative frameworks essential for large-scale renewable energy and green hydrogen projects in Indonesia.

The launch event, held in Jakarta on 26 March 2025, brought together senior officials from three ministries and national agencies as well as more than 50 participants representing broader hydrogen industries and civic organisations.

Green Hydrogen Financing & Off-take (Ginting & Reksodiputro in association with A&O Shearman):

The report emphasises the importance of diversifying revenue streams, structuring off-take agreements strategically, and leveraging the unique roles of State-Owned Enterprises (SOEs) to advance project development.

Pricing & Government Support (Witara Cakra Advocates):

The report explores various pricing models, drawing comparisons with existing subsidies in Indonesia’s mining, electricity, and oil & gas sectors. It introduced three green hydrogen pricing schemes: hybrid pricing, dynamic pricing, and a floor price approach.

Green Hydrogen Certification and Categorisation (HHP Law Firm):

The report highlights the need for well-defined certification criteria, mutual recognition frameworks, transparency, adaptability, and strong government support to build investor confidence in Indonesia’s green hydrogen market.

Business Permits & Regulatory Frameworks (Herbert Smith Freehills):

The report discusses the licensing framework for green hydrogen projects, advocating for legislative models that clearly define green hydrogen, ensure public access, enable infrastructure development, and establish an independent regulatory regime. The report, developed in collaboration with Herbert Smith Freehills (Hiswara Bunjamin & Tandjung), is currently undergoing final revisions to ensure accuracy and completeness. It will be published and made available shortly.
